Privacy- and cookie statement of the International Accord Foundation

 Via our website internationalaccord.org (hereinafter: the website) and services, personal data is collected, and cookies are being used. As Stichting International Accord Foundation (hereinafter: International Accord), we respect the privacy of the visitors of our website and ensure your personal data is handled confidentially. Therefore, personal data collected by us, is being carefully processed and secured, in accordance with the requirements for the processing of personal data laid down in data protection legislation. In this privacy and cookie statement we inform you about the personal data processing by the International Accord and about your privacy. We would like to recommend you to read it carefully. 


During the processing of personal data, we comply with the requirements of the applicable data protection legislation. This means we:

  • clearly specify our purposes before we process personal data, by means of this privacy and cookie statement;
  • limit our collection of personal data to only the personal data needed for our legitimate purposes;
  • first ask for explicit consent to process your personal data in cases where your consent is required;
  • take appropriate security measures to protect your personal data and we demand the same from parties who process personal data on our behalf;
  • respect your right to inspect, correct or delete your personal data held by us.

For which purposes do we process personal data?
In this privacy and cookie statement, we explain why and for which purposes we use personal data. In order for us to manage the Accord agreement, we process personal data for several purposes, which are detailed below. We also inform you about the categories of personal data we need for this, our legal basis and retention periods.


Contact
You may contact us by filling in our contact form, by sending an e-mail or by calling us. It is also possible to contact us through social media. For this purpose, we use your name, email address, phone number and content of the message. We will process this personal data for performance of the agreement, namely to contact you after you requested us to do so. We store this information until we are sure that you are satisfied with our response.


Newsletter
We send out a newsletter to inform those interested in our activities and services. Each newsletter contains a link that enables you to unsubscribe from our newsletter. Your e-mail address is added to the list of subscribers, only with your consent. We store this information until you cancel your subscription.


Our services:  Supporting signatories in meeting their obligations under the agreement, liaising with the RSC on factory inspections, monitoring remediation, safety training and handling and solving safety complaints.


In order for us to perform the Accord agreement, we monitor safety inspections performed by the RMG Sustainability Council (RSC) at all factories producing for Accord signatory companies. We also monitor remediation progress and facilitate brand support, liaising with the RSC on safety training, handling and resolution of safety complaints. For this purpose, we may utilize names, functions, contact details and correspondence of data subjects from both the factories and the signatory companies. We store this information for as long as we think this is necessary to achieve this purpose.


Data submission
When confirming you contact details and interest to continue receiving Accord communications, the data you provide to the Accord will be used to perform the agreement that the Accord has with your organization. These data are used only for operational purposes to implement the Accord (e.g. in email exchanges between you and the Accord or you and the RSC), and to inform you of Accord and RSC activities. We will retain the data for as long as your organization is part of the Accord.


These data may be shared with company signatories that are also sourcing from (or have sourced from) the same factory for which your company is also responsible.


Job vacancies
If you apply for a job vacancy, we will ask you to provide the following personal data:

  • CV
  • Cover letter


We process your data in order to implement the agreement, namely to consider you for an employment contract. If we end up hiring you, we will store your personal data for as long as you work for us and will erase your personal data (provided by you within the application procedure) within two years post-employment.


In case we end up not hiring you, we will erase your personal data within six weeks after the ending of our application procedure unless we have requested consent from you to store your personal data longer because of a potential suitable function that may become available at a later moment. When this is the case, we will store your personal data for a maximum of one year after having obtained your consent.


Social media check
A social media check may be part of the application procedure. A social media check is necessary to be able to guarantee that the image of the International Accord will be maintained when new staff is being hired. For our social media check, we will visit your personal pages on Twitter, Facebook, YouTube, Google, LinkedIn and/or any other websites you provide us with during the application procedure. We will store the information that we collect for up to a maximum of six weeks after the termination of the application procedure, regardless of whether we accept your application or not.


Other retention periods
Personal data will not be stored longer than necessary in order to achieve the purposes as described within this privacy and cookie statement. Only when we are obliged to, based on a legal obligation, will we establish a longer statutory retention period.


Providing to Third Parties
We collaborate with other organisations, that may receive your personal data. We share data with our IT service providers. We safely store the data in Google database, which is hosted on Google’s servers, physically located in the European Union (EU), and in our Fair Factories Clearing House (FFC) database, which is physically located in Ireland and the United States. We have made appropriate agreements with our suppliers, such as Google, to safely handle your personal data, as well as with your company. Please refer to the confidentiality agreement that your company has signed (or is about to sign) with FFC.


The data can be extracted from FFC and stored for operational purposes in – for example – MS EXCEL sheets, which in turn are stored in European Google Drive servers, Dropbox servers, and/or in the RSC servers in Dhaka, Bangladesh. These data can be accessed by or shared with:

  • Current employees of FFC;
  • Current employees of the Accord;
  • Current employees of the RSC;
  • Trade union signatories of the Accord;
  • Witness signatories of the Accord;
  • Steering committee members of the Accord;
  • Board members of the RSC (including, brand, labor and industry members).


We also collaborate with the RMG Sustainability Council (RSC). Effective 1st June 2020, the RSC continues the work of the Accord in Bangladesh and sustain the achievements reached in occupational health and safety remediation, safety training and safety complaints processing within the Bangladesh RMG industry. The RSC is governed by a Board of Directors consisting of an equal number of representatives from industry, brands and trade unions. Depending on the nature of your inquiry to the Accord, it might be necessary to share your personal data with employees of the RSC to obtain an answer to your query. We will not provide your personal data to other companies or organisations, unless we have a legal basis to do so, or if the third party is our supplier.


Cookies
Our website makes use of functional, necessary cookies and Google Analytics cookies, to generate overall statistics and gain insight into the use of our website by the public to optimize our website and services. Cookies are small files in which we can store information, so that you do not have to fill that information again. We can also use them to see whether you are visiting us again.


Most cookies have an expiration date. This means that they will automatically expire after a certain period of time and no longer register any data concerning your visit of the website. We use Google Analytics cookies in a privacy friendly manner. This means that we accepted the data processing agreement from Google. We do not allow Google to use information obtained by Analytics for other Google services, and we anonymize the IP-addresses. Google is, however, able to provide information to third parties in case Google is legally obliged to do so, or if these third parties process the information on behalf of Google. Security
We have taken security measures to prevent misuse of and unauthorized access to personal data. We take responsibility in the security of your personal data. We renew our security measures to ensure safe storage of personal data and keep track of what might go wrong.


Changes to this Privacy Statement
We reserve the right to modify this statement. We would like to recommend you to consult this statement on a regular basis, so that you remain informed of any changes.


Your rights
You are always able to contact us if you have any questions regarding our privacy and cookie statement or wish to exercise one of your rights.
